JUDGEMENT 
The Originating Summons in this case is brought pursuant to S. 36 (1) of the 
1999 Constitution (as amended), Order 3 (6) and (9) of the Federal High Court 
(Civil Procedure) Rules, 2019 (hereinafter referred to as FHCCPR 2019) and 
under the inherent jurisdiction of this Court for the determination of the following 
questions:

Whether the Plaintiffs as importers with express permit of the

Defendant and not iicensees who engage in the bulk sale of 
Petroleum products under section 174 (1) @) of the Petroleum 
industry Act, 2021 (PIA) are bound by the provisions of the
